Ley de Ordenación de la Edificación · Ley 38/1999 · Building Act
Spain's Building Act, which sets who is liable for defects in new buildings, for how long, and how off-plan payments are protected.
Article 17 sets liability periods from the acceptance of the works: ten years for structural defects, three years for defects in elements or installations that affect habitability, and one year for defects in finishing work, for which the builder alone is liable. Article 19 makes the ten-year insurance compulsory for housing.
Its first additional provision obliges developers to guarantee off-plan payments with an aval bancario or insurance and to use a special account.
